SCOTUS Back To Work Tomorrow: Buckle Up

Supreme Court

United States Supreme Court, Washington, D.C.

Tomorrow is the first Monday of October. In the US this year this means that we will be looking at the new Supreme Court session. This time around for the first time in a long time there will be a solid 5 to 4 conservative advantage with little expectation of any swing voting.

The solid conservative block seems to have been picked with two criteria in mind: 1) they are ideologically pure and 2) they are young.  The current ages of the conservative justices are:

CJ John Roberts                  64

Justice Clarence Thomas    71

Justice Samuel Alito.           69

Justice Brett Kavanaugh.    54

Justice  Neil Gorsuch           52

Most justices seem to last until at least 85 these days. Simple math indicates a solid radical right bend to the SCOTUS for at least 15 more years. This was one of the top reasons why getting a right winger into the presidential seat was so important in 2016 that interference by outside countries, voter suppression and black box voting machines were acceptable to the right.

Now, finally with the solid ideological leanings the right has long dreamt of, many on the right are hoping that the SCOTUS will become their great engine of social change to reform the country to their beliefs. It looks like that will be the direction from the get-go Tuesday when the first arguments of the new term are heard in cases that will have major implications for LGBTQ folks and their families.

“The Supreme Court will hear three cases next Tuesday that ask whether it is legal to fireworkers because of their sexual orientation or gender identity. That alone is enough to make them three of the most important employment discrimination cases in many years. But there are additional layers to these cases, layers that could imperil all workers regardless of whether or not they are LGBTQ.

The defendants’ arguments would reopen long-settled legal arguments, potentially upending much of federal anti-discrimination law in the process.

At the most fundamental level, Altitude Express Inc. v. Zarda, Bostock v. Clayton County, and R.G. & G.R. Harris Funeral Homes v. EEOC are cases about whether the existing federal ban on sex discrimination forbids employment discrimination against LGBTQ workers. Zarda and Bostock involve Donald Zarda and Gerald Bostock, gay men who allege they were fired because of their sexual orientation. Harris Funeral Homes involves Aimee Stephens, a trans woman who was fired by a boss who claims that he would violate “God’s commands” if he allowed Stephens “to deny [her] sex while acting as a representative of [the] organization.”

The text of the law bans only “sex” discrimination, not discrimination based on a worker’s sexual orientation or gender identity. These cases ask whether concepts like sexual orientation and gender identity are so tightly bound to the concept of sex (meaning gender, not sexual intercourse) that a ban on sex discrimination necessarily protects LGBTQ workers.

They are also the first big test of how the Supreme Court’s new majority will treat LGBTQ rights cases. Though retired Justice Anthony Kennedy was a conservative, he also authored the Court’s most important gay rights cases. Zarda, Bostock, and Harris Funeral Homes will tell us a great deal about whether it is possible to assemble a pro-LGBTQ majority on the Supreme Court without Kennedy’s vote.”

There is an in depth discussion of the cases and their potential large implications at the link. It is a fascinating read.

For our purposes, we are using it as an illustration to point out that now that the right has their people in place, they plan on wasting no time in restructuring society from the halls of the Supreme Court. Many of us have been thoroughly scared of what will happen to Roe v. Wade. It now looks like crunch time is here.

Of course Roe v. Wade is not expected to be the only casualty. Certainly workers rights will be on the target list as will a vast expansion of the privileges of businesses. One set of issues that many of us tend to ignore is the separation of church and state. Actually in this case I think we will be looking at a much looser reading of the privileges of religion in our society and a much lesser role for those who wish for a secular society.

Will we see the SCOTUS roll back the ACA? No doubt the right will see this as one of the things they won when the presidency was taken over by their Chosen One. Whether the ACA is declared unconstitutional this year or not, you can surely expect any further expansion of health care to be constantly on the SCOTUS docket as future congresses and presidents try to bring America into line with the rest of the modern world with health care.

Even what seem to be the last two bulwarks of the New Deal – Social Security and Medicare – may be in the sights of this Court. This has been the dreams of the right for 80 years or more. They are finally in position to roll the country back to the 19th century. SS and Medicare must go in their view.

Voting makes a difference.

Sunday Funday: Greta Thunberg Comes To Iowa City Edition

Iowa City had the great honor of hosting Greta Thunberg Friday. For those who are unaware of who Thunberg is, she is a quiet, Swedish teenager who has taken on the task of saving the world from climate change. It may seem a hefty task, but so far Thunberg has shown herself up to it. She could use a little help, though, from each and every one of us.

Your task for this fall: Do a self-assessment and find ways to cut down your carbon footprint.

WE and only WE can save our planet. There is no ‘Planet B.’

When the Chosen One admits to crimes let’s believe him. When he goes to do int again, let’s stop him!

  1. Crazy weather abounded in the US. Four feet of snow fell in what state last Monday?
  1. Heat, heat, heat in the eastern US including over 100 degrees in what capital city of Alabama?
  1. The Chosen One doubled down on his call for foreign help for his 2020 campaign. This time what country did he call on to investigate former VP Joe Biden?
  1. Republican Christopher Collins of New York resigned his congressional seat after pleading guilty to what federal charge last week?
  1. The Republican National Committee used forms that closely resembled what official government document to solicit money?
  1. The schism at Fox News goes on as what judicial analyst argued that the the Chosen One committed impeachable offenses?
  1. Rumors are rife that what member of the cabinet will be leaving in November as he appears to be caught up in the Ukraine scandal?
  1. Shades of congressional races of the past! What Ottumwa eye doctor will make run #4 for Iowa’s 2nd district seat?
  1. What former Republican senator is urging his party to “save your souls” and oppose the Chosen One in 2020?
  1. What visiting head of government was caught in the middle of a melt down by the Chosen One as he went after the media during a joint news conference?
  1. What Iowa Speaker of the House announced her retirement at the end of the next session of the legislature?
  1. What top tier Democratic presidential candidate had to take a few days off due to blockages in his arteries?
  1. What drug manufacturer reached a $20 million settlement with 2 counties in Ohio for their part in the opioid epidemic?
  1. Which cabinet secretary denied any knowledge of the call with Ukraine several times before finally admitting that he was also on the call?
  1. The WTO authorized the US to impose tariffs on $7.5 billion of goods from what area?
  1. What top tier Democratic candidate was chased through the Reno, Nv. airport by followers of the Chosen One?
  1. Dallas police officer Amber Guyger was found guilty of what charge in her shooting of her neighbor Botham Jean?
  1. How many Democratic presidential candidates will be on the stage for the October 15th debate?
  1. Perhaps the strangest product in the annual “what can we put pumpkin spice in” contest this year is what well known pork shoulder product made by Hormel?
  1. What mall staple fashion chain filed for bankruptcy protection, saying it will close up to 178 stores?

In the time it took me to cross the street, the president* asked two foreign countries to help him ratfck the 2020 election.

That’s some impressive crimin’ right there. – Charles P. Pierce

LULAC Scores Major Victory For Latino Voters in Iowa

LULAC

Nation’s Oldest & Largest Latino Civil Rights Organization Sees a Win Against Voter Suppression Legislation in the State

From: Domingo Garcia, LULAC National President <info@lulac.org>

Washington, DC – A District Court Judge in Iowa issued an important ruling Tuesday in a major win for LULAC by overturning several major elements of a voter suppression law that was passed by the state legislature in 2017. The judge’s ruling sends a clear message to those who would attempt to violate our right to vote.

“This is a victory for our community throughout the United States,” says Domingo Garcia, National LULAC President. “Most especially, this ruling recognizes the sacrifice Latinos and Hispanics have made in the struggle to ensure our civil rights and especially the right to vote,” he added.

The decision by Judge Joseph Seidlen rejected requirements that Iowa voters must provide a voter ID number to get an absentee ballot or that people who could not produce a driver’s license or ID issued by the state could be denied a voter ID card. Also thrown out was a rule that rejected votes from people based on a person’s signature.

“LULAC worked hard in Iowa to make our community aware of the legal requirements for voting and this decision vindicates all our effort,” said Joe Henry, President of Council 307 and Special Advisor to the President. “On all counts, the court’s ruling clears the way now for our Latino votes to play a major role in 2020 and we’re going to continue urging Latinos to make their voice heard,” he added.

Iowa has a growing Latino community in the state and already 70% of adult Latinos and Hispanics are registered to vote. Now, LULAC is working to boost Latino voter turnout by another 25,000 to show the country that our community will play a decisive role in the 2020 primaries and general elections.

“We must continue to be diligent and determined in fighting voter suppression whether it’s in Iowa or anywhere else in America,” says Nick Salazar, Iowa State Director. “This legal ruling is an important step but we have to stay alert in our local polling places, county election centers and state capitols to ensure our votes are counted,” he concluded.

The following is a summary of the judge’s ruling —

•The court permanently enjoined the signature match provisions for absentee ballots finding that they violate the Iowa Constitution.

•The court permanently enjoined the State from saying that an ID number is required to request an absentee ballot and it leaves in place an earlier ruling that county auditors may complete an absentee application that is missing an ID number using the state’s voter records. The temporary injunction against considering the ID number at all was dissolved.

•Finally, although the court said that the overall voter ID requirement is constitutional, it required the Secretary of State to permit county auditors to provide all registered voters with a free Voter ID Card upon request.

Saturday Twofer: Internet Trolls And The Real Lesson Of Ukraine

I ran across two stories this week that offer some positive outlooks on a couple of bleak issues in our society today.

The first is a TED talk from journalist Andrew Marantz discussing the bizarre world of internet trolls. The video is just short of 15minutes, but believe me, it feels like a couple of minutes. Marantz ends with some good suggestions for defying the trolls at the end:

For part two of the twofer we bring back our old friend Robert Reich. In this week’s comment Reich discusses the real lesson of the crisis around the current president and his willingness to defy our laws in illegally reaching out to other countries to get dirt on his political opponents:

“But if the 2020 election is going to be—and be seen as—legitimate, the nation will need many more whistleblowers and officials with integrity.

States must upgrade all election machinery and equip them with paper ballots that can be audited. Facebook and YouTube must devote more resources to protecting against malicious foreign trolls and bots.

All of us will need to be vigilant.

Over the last two and a half years, Trump has shown himself willing to trample any aspect of our democracy that gets in his way—attacking the media, using the presidency for personal profit, packing the federal courts, verbally attacking judges, blasting the head of the Federal Reserve, spending money in ways Congress did not authorize, and subverting the separation of powers.

Trump believes he’s invincible. He’s now daring our entire constitutional and political system to stop him.”

As we have seen throughout the past two weeks since the stories of a  whistleblower’s report started and then the actual whistleblower’s report was released is that not only is the current president in anyway ashamed or remorseful of his conduct, he appears to be proud of what he has done. He is so proud of what he has done that he openly continues to defy the very laws that he swore to uphold.

We have seen conduct like this before. Unfortunately in those instances our country chose to pardon the offenders thus sending messages to the future that criminal conduct will be tolerated and even rewarded. The previous examples are the Watergate affair and Iran-Contra.

When Gerald Ford exonerated Nixon for all crimes he sent the biggest message ever that presidents in particular are above the law. That must stop now.

The current president has not only admitted to breaking the law, he presented Congress with the evidence (though not all of it) of the crime. Then as if to flaunt he openly, in front of cameras and microphones. called on other countries to join in on breaking US laws.

If this president gets away with openly breaking our laws we will have created a king. If any in his administration get away with aiding in his lawbreaking then we have set the executive branch above the law. This includes VP Pence, AG Barr and SecState Pompeo.

And those in congress who are so fearful that standing up for the laws that define our country will cause them to lose an election (Joni Ernst eg.) do not deserve to be representing the American people.

###

Quick updates before the end of the month. [Tea Party associated] FreedomWorks is still attacking us, with another Tweet Saturday. And Congress has headed home for recess, which means it’s time to show up at EVERY TOWN HALL and EVERY OFFICE to demand impeachment and a fair and open trial in the Senate.

Between FreedomWorks, the Defund Hate Week of Action, sending more than 1,000,000 text messages, and making 12,000 calls (literally) about impeachment, it’s been a ridiculously busy September. All of that work is continuing into October, plus some new program launches and calls to action on the horizon — and all of it depends on grassroots support to keep running.

We’re not going to let up. Our democracy, our national security, and the future of our nation are all at stake, we know how to use our numbers to pressure Congress for real change, and we won’t let the right wing scare us off. But this isn’t going to be the last busy month, and we need to be ready every time. Please: pitch in $10 right now, before the end of the quarter at midnight, to fight back against the right, fund the tools of the resistance, and support all of Indivisible Project’s work so we’re ready, no matter what news breaks next.

In solidarity,
Indivisible Team

P.S. — A bit of good news: Yesterday, we reached our goal of raising $22,000 to cover unexpected costs including the 1 million text messages we sent this month to rally Indivisibles around impeachment. Thank you, thank you, thank you! That’s a big worry in our budget relieved! But we still have a ways to go to hit our full monthly goal (the number before that added expense) so anything you can chip in today will really help.

P.P.S. — We’ve seen more than a few folks tweeting at FreedomWorks after they donate to Indivisible to let them know what inspired the gift. Love. That. 😍😍😍

Indivisible Project is a locally-led, people-powered movement of thousands of local groups in red, blue, and purple states, and in urban, suburban, and rural areas. Trump Impeachment Will Test The Strength Of The Right Wing Propaganda Machine

Fox News is the propaganda arm of the Trump white house.  But it seems lately the right wing propaganda machine seems to be cracking.

“It is a crime for the president to solicit aid for his campaign from a foreign government… That to which he has already admitted, is a crime.”  – conversation between Andrew Napolitano, Fox News legal analyst, and Fox News anchor Shep Smith.

I mentioned to a friend just the other day that I believe the impeachment of Donald Trump and the 2020 election will be a test of the power of the right-wing propaganda machine.  Gabe Sherman, Vanity Fair special correspondent, concurs.  This is one of several interesting things he said last week on Lawrence O’Donnell’s Last Word.

“Fox News was created by Republicans so that Watergate would never happen again. We are now entering what appears to be that Watergate moment. Will the power of Fox News be able to hold the line or will the dam break?”

Great Iowa Treasure Hunt; Do You Have Unclaimed Money?
Demand Remains High for New Blackout License Plates
Iowa Moves Forward on School Bus Seat Belts
Grants Available to Expand Broadband Access
Flood Mitigation Board Approves New Assistance
Public Hearings Set on Use of Seclusion Rooms in Schools

Great Iowa Treasure Hunt; Do You Have Unclaimed Money?

Every year, there are millions of dollars turned into the State Treasurer’s office as lost or abandoned property. This property comes in the form of safe deposit box items, dormant financial accounts, unclaimed utility refunds, uncashed checks, and stock certificates and dividends.

The State Treasurer’s office becomes the holder of these assets until the missing owner can be found. Owners are located through mailings, publications, and listings that are displayed at the Iowa State Fair. There is no time limit to file a claim, and there is no fee assessed once the property or money has been returned the owner.

To date, the Great Iowa Treasure Hunt program has returned over $267 million in unclaimed property to more than 592,000 people since Treasurer Fitzgerald created it in 1983.

To see if you have unclaimed property or money visit: https://greatiowatreasurehunt.gov.

Demand Remains High for New Blackout License Plates

With nearly 20,000 plates sold since first becoming available July 1, the demand for Iowa’s new blackout license plates still remains high. The black and white plates, approved during the 2019 Legislative Session, sold quickly with most counties running out or running low in the initial month after their release.

Iowans are able to exchange any plates for non-personalized blackout license plates at local county treasurer’s offices, which saves the two- to three-week order processing time if the plates are ordered online or by mail. The new blackout license plates will not have the same letter/number combination as your current plates.

If you currently have a personalized plate and would like to switch your personalized message from that plate to the new blackout plate design, you will need to complete the mail in form found at https://iowadot.gov/mvd/vehicleregistration/vehicleregistration/plates/blackout.

The blackout plates are considered a specialty plate, so they are subject to an additional fee. The new plate will cost $35 for a non-personalized, alpha-numeric plate and an additional $25 (for a total of $60) for a personalized plate. An additional fee of $10 for non-personalized and $15 for personalized plates will be added to renewal registration fees.

Funds collected for the blackout plate will go to the Road Use Tax Fund, which funds state, county, and city road and bridge projects throughout Iowa.

Iowa Moves Forward on School Bus Seat Belts

A final approval was given that would require new school bus purchases starting October 2nd to be equipped with 3-point shoulder belts. Agreed to by the Iowa Legislature’s Administrative Rules Review Committee, this new rule is aimed to reduce whiplash in a crash and also save lives in a roll-over situation while students are on a school bus.

The rules did not include a requirement for fire suppression systems, something that the National Transportation Safety Board concluded was a factor in the Oakland Iowa school bus crash that killed the driver and one student.

Crash test demonstration on school bus seat belts by the Iowa Public Transportation Association can be found at https://www.youtube.com/watch?v=9TJZe7Ost_A.

The multiple requirements include the following:

    • • School districts to document that bus evacuation drills are being done twice a year, as required by law.

• More safety equipment on buses, including 3-point shoulder belts, reflectors and an additional stop arm at the back of the bus to help prevent drivers from passing stopped buses.

• Inspections will include all school vehicles used to take students to and from activities. Currently smaller vehicles are used to transport a small group of students for an extracurricular activity. They often travel much greater distances to an event compared to a school bus, but yet are not currently inspected.

• Allowing school districts to increase school bus ride time (currently 75 min. one-way for high school and 60 min. for elementary) by 15 min. if they have a public hearing. The longer bus rides will likely affect elementary kids the greatest due to longer rides without a break.

Grants Available to Expand Broadband Access

Grants are now available to expand high-speed internet access to underserved areas of the state. Applications will be accepted through October 18, 2019 and $5 million in total grant money is available.

Up to 15% of project costs for broadband expansion into Targeted Service Areas are available. Private selector service providers or public sector entities are eligible for the grants. New maps for eligible areas were recently released by the Office of the Chief Information Officer.

The grants are made available as part of the Empower Rural Iowa Broadband Grant Program. Legislation expanding the Empower Rural Iowa grants was passed by the legislature this year on a bipartisan, unanimous vote, this year.

Additional information on the grant process and applications can be found at https://ocio.iowa.gov/notice-funding-availability-002. Updated maps showing targeted areas for the grant funding can be found at https://ocio.iowa.gov/broadband-availability-map-version-2.

Flood Mitigation Board Approves New Assistance

As the third round of flooding wreaks havoc on the western side of Iowa, the Iowa Flood Mitigation Board has approved $15 million to buy out homes damaged by the floods and repair levees. Some communities such as Hamburg, Hornick, and Pacific Junction received some state funds, but did not receive all the money it asked for.

Earlier this spring the Missouri River went over its banks and over levees, destroying homes and farm fields throughout western Iowa. Even though the board allocated $15 million, some projects and needs were not met, such as a project in Muscatine County as well as a levee project on the Missouri River.

Last Legislative Session, the Legislature created the Flood Recovery Fund under the control of the Iowa Flood Mitigation Board. The Flood Recovery Fund includes money appropriated from the General Assembly, as well as other money available to be developed in the fund. For a project to be eligible for funding, it has to support flood response, flood recovery, or flood mitigation activities.

Public Hearings Set on Use of Seclusion Rooms in Schools

Six meetings to gather public input on proposed revisions to rules regarding the use of seclusion rooms in schools will be held by the Iowa Department of Education (DE) from Sept. 24 through Oct. 3.

Proposed revisions to Iowa Administrative Code chapter 281-103 (“Chapter 103”) were voted down by the State Board of Education in August so that more feedback can be collected on some parts of the proposed rules, including seclusion room requirements, parent notification, and the term “serious physical injury.” The rewrite of the rules was requested by a petition filed by the ACLU and parents of children that were placed in seclusion rooms for an excessive amount of time.

The public input meetings will run from 4:30 p.m. to 6 p.m. Dates and locations are as follows:

Tuesday, September 24

White House Kills Gun Legislation Over Impeachment

Image (2) warren-burger-on-guns-300x300.jpg for post 32938

This is simply one of the sickest misdirections I have ever heard. We are in a absolute crisis in this country due to guns. Anyone who is concerned about the health and happiness of the majority of citizens in this country should be concerned about working to get our laws on guns much more stringent.

Seeing children massacred at schools, people shot in churches or synagogues, people mowed down in massacres at theaters, night clubs and outdoor gatherings should be enough to make every American call their representative and scream “Stop This Insanity!”

Democrats have worked and passed legislation in the US House to tighten gun laws. They are ready at any time to enter into negotiations on this legislation. Yet over in the senate, Mitch Mcconnell, the self described “Grim Reaper” of stalling legislation from the House has proudly bragged that he will kill any bills coming from the Home, including the much desired gun legislation.

But in a strange move by the Republican Party, with rumors of an impending impeachment swirling around the current president, we suddenly hear stories that the White House was in negotiations on gun legislation. Now the White House claims that any negotiations on the gun bill are dead, killed by the House Dems move to impeach the president. From salon.com:

Republicans have ended negotiations on a bill that would expand background checks for gun purchases because of House Democrats’ push for an impeachment inquiry into President Trump.

A Senate staffer told Washington Free Beacon reporter Stephen Gutowski that “gun legislation is dead, at least for the time being, because of the impeachment inquiry” that House Speaker Nancy Pelosi announced Tuesday.

Trump lashed out over the impeachment inquiry on Twitter, arguing that Democrats were “so focused on hurting the Republican Party and the President that they are unable to get anything done because of it, including legislation on gun safety, lowering of prescription drug prices, infrastructure, etc.”

Trump did not mention that a recent gun bill proposal from the White House was quickly leaked and widely slammed by the NRA and gun groups before it was abandoned by the administration. He did not mention that Senate Majority Leader Mitch McConnell vowed to block the House-passed prescription drug bill from being debated in the Senate and is already blocking a House-passed background-check bill. He did not mention that he himself killed infrastructure talks by demanding that Democrats stop all investigations into his administration and personal finances.

In fact, the House has passed 395 pieces of legislation since January. McConnell has blocked nearly all of them and compared himself to the “Grim Reaper” as he vowed to block future legislation.”

So there you go. The Republican Party is only willing to consider legislation to protect the safety of your family if Democrats are willing to ignore the ’in your face’ wrong doing by the current president. Just so you understand where your safety and that of your family stands with the Republican Party. It means nothing to them. Nothing unless they can extract something for themselves out of it. And on their plus side, they have lined up with the NRA yet again.

Can you say “hostage?”
