What do you call an unsuccessful insurrection? A rehearsal

The US Senate voted on a measure Tuesday January 26th concerning the constitutionality of impeachment charges being brought against Donald Trump for his role in the January 6th insurrection at the nation’s capitol. At least 5 people lost their lives in the insurrection and scores were injured. 

Donald Trump was still the president and would be for two weeks. He was involved in the insurrection at least to the point of making a speech just prior to the storming of the capitol. Expect that a case that his administration – for which he is responsible – was also negligent in their handling of the day’s events.

Ernst voted that the impeachment trial is not constitutional because Donald Trump is now a private citizen. He was not a private citizen at the time of the insurrection. At that time he was responsible for the actions of his administration. Suddenly when he leaves the presidency he is no longer responsible? What the Hell? 

During Trump’s presidency he was shielded from being brought to justice for some of his most egregious actions because of an little known opinion from some lesser light in the justice department 50 years back that a president could not be bothered by legal action against him while president. 

Based on that Trump had the amazing luck of not having to answer for illegal acts as president and the suddenly not being responsible for what he did as president as soon as he is no longer president. Hmmmmmm ….. looks like the classic “Man above the law” that could never happen in the US. 

Yet Joni Ernst believes Trump should be above the law and not be held accountable for his actions. Her logic is that since Trump is now a private citizen, constitutional rules do not apply to private citizens once they are no longer in office, even though the transgressions were committed while in office. That is twisted logic that rivals the twists in a double helix DNA strand. Got to wonder how many times she ran into herself noodling that one out.

Based on that, if your county treasurer is embezzling county funds their best move would be to quit and go back to private life. Based on Ernst’s logic, as a private citizen the former treasurer is no longer responsible for what the then county treasurer did as a public employee. I am guessing in Ernst’s world, the treasurer would get to keep the money too. 

This is a woman who is expected to make laws for the country. I can’t believe that Iowans took the measure of Ernst and Theresa Greenfield and decided that Ernst was a better choice.

Even more sad is that Ernst doesn’t think Trump had anything to do with the insurrection, despite tons of tweets, TV appearances and recordings that have Trump all but giving the final command to Charge!

U.S. Sen. Joni Ernst said Tuesday she doesn’t think the Constitution allows the U.S. Senate to finish the impeachment process for former President Donald Trump, now a private citizen.

Ernst, a Republican, said she would continue to weigh arguments from legal scholars on the matter, however. She also doubted that Trump’s role in instigating a mob to storm the Capitol, and not attempting to rein it in immediately, rose to the legal definition of inciting an insurrection.

“My concern right now is that the president is no longer in office,” Ernst said in a statement Monday night. “Congress would be opening itself to a dangerous standard of using impeachment as a tool for political revenge against a private citizen, and the only remedy at this point is to strip the convicted of their ability to run for future office — a move that would undoubtedly strip millions of voters of their ability to choose a candidate in the next election.”

As the little joke at the beginning of this post indicates, if those behind the insurrection are not held to account, it is almost guaranteed to happen again.

Iowa Republicans To Defund The Public Schools

Public education funding is at risk. Will you help us tell Iowa senators that public tax dollars should stay in public schools?

SF 159, the legislation for school vouchers, has been rushed through committees and senators are now preparing a vote. This legislation would divert funding away from public schools in order to fund non-public schools. That’s why we need your help to contact Senators before today’s debate. 

Non-public schools are not held to the same standards as public schools. For example, non-public schools are permitted to discriminate. We cannot allow our public tax dollars to support schools without the proper oversight. Will you join us and tell your senator to vote no on SF 159?

Iowa’s Tom Miller Only Democratic AG To Stand With Big Oil

Des Moines, Iowa — In a ruling issued today by the US Court of Appeals, the Standing Rock Sioux Tribe won a partial victory after a long court battle against the Dakota Access Pipeline (DAPL). The Court required the Army Corps of Engineers to conduct an Environmental Impact Statement (EIS), which has significant ramifications for the future of the pipeline. However, the Court declined to shut down the pipeline while that EIS is in progress, making the ruling a partial victory for the Tribe and its allies.

Among those lining up on either side of the case, 30 attorneys general weighed in. Eighteen supported the Tribe (sixteen states, plus Guam and Washington, DC). Twelve supported the pipeline company. The lone Democratic attorney general supporting DAPL was Iowa’s Tom Miller.

“We could not be more disappointed in Attorney General Tom Miller,” said Bold Iowa director, Ed Fallon. “In siding with Big Oil against the Standing Rock Sioux Tribe, Miller also stood against the many Iowa farmers and landowners forced to fight DAPL as their land was stolen through eminent domain. Miller also stood against the many Iowans working to address the climate crisis. If the pipeline leaks or breaks, we’ll remember that Miller stood against protecting Iowa’s water, too.”

Miller is the longest-serving attorney general in US history, having held the office for 38 years.

Bold Iowa was founded in 2015 in response to the Dakota Access Pipeline to build rural-urban coalitions to (1) fight climate change, (2) prevent the abuse of eminent domain, (3) protect Iowa’s soil, air, and water, (4) defend the rights of farmers, landowners, and Indigenous communities, and (5) promote non-industrial renewable energy.

Demand US Companies Cut All Ties With Fox News

Fox News is the gateway to right-wing extremism. With thousands of Americans dying every day from the COVID-19 pandemic and the violent right-wing attack on the U.S. Congress on January 6, 2021, Fox News’ dangerous disinformation increasingly poses a direct threat to our democracy.

We must put pressure on these top Fox News advertisers to demand that they stop funding Fox’s lies and stop profiting from deadly disinformation and extremist right-wing violence.

In the two weeks after the 2020 election, Fox News cast doubt on or pushed conspiracy theories about the election result nearly 800 times. It fueled conspiracies and attacks on democracy, told their viewers the election was invalid, and stoked extremist violence.

Fox News has a long history of spreading misinformation. Whether it is speaking on COVID-19, the Movement for Black Lives, the election, or the climate, Fox News puts lies above the truth. Any advertising company continuing to give money to Fox News is profiting from and complicit with their misinformation, white supremacy, and extremist fear-mongering.

By backing election and COVID-19 misinformation on Fox News, advertisers are putting profit above the health and safety of people and our democracy. While more than 70 companies have publicly announced that they will cut ties with Sean Hannity’s, Laura Ingraham’s, and/or Tucker Carlson’s prime-time shows on Fox since 2017, it is now clear that any company that claims to support American democracy must immediately cut all ties with Fox News.

It’s long past time to hold Fox News accountable. Together, we can pressure companies to stand up for public health and for our democracy.

IA-02 Recount: Twenty-Two Uncounted Ballots Will Put Hart Ahead By Nine Votes

22 Legally-cast, Uncounted Ballots Will Put Hart Ahead by Nine Votes

WHEATLAND, IOWA — Today, as part of the next step in the election contest filed by Rita Hart on December 22, Mariannettee Miller-Meeks officially moved to disenfranchise at least 22 Iowa voters who have not yet had their votes counted in the race for Iowa’s Second Congressional District. Following an inconsistent recount process which Miller-Meeks acknowledged left votes uncounted, Rita Hart has asked the U.S. House for a full and thorough recount of every ballot in the race to ensure the outcome was accurate.

“As I have said from the beginning of this entire process, nothing is more important than ensuring every Iowan has their vote counted. But at this moment we know twenty-two voters in Iowa’s Second Congressional District still have not had their legally-cast votes counted and thousands of other voters have not had their ballots examined, which is why I filed a contest in the House to ensure these voters are not left disenfranchised.” said IA-02 candidate Rita Hart.   Mariannette Miller-Meeks herself has acknowledged that there are votes yet to be counted, which makes her attempt to stop votes from being counted even more disappointing. It is crucial to me that this bipartisan review by the U.S. House is fair, and I hope our leaders will move swiftly to address this contest and ensure all votes are counted. Iowans deserve to know that the candidate who earned the most votes represents them and after making sure all ballots are counted, it will be clear that I have won this election.”

On background, here’s what some of the IA-02 voters whose legally-cast ballots have yet to be counted have said about why their votes should be counted:

“This is my first time voting and I was really excited to elect Rita for my first person vote,” said Johnson County voter Trajae Lackland. “You know, coming from history and … how people of color, wasn’t being able to vote, it really hurts my heart that I didn’t, I didn’t get to vote.”

Johnson County voter Mike Overholt said “I submitted my ballot, and I sealed the envelopes as best I could. And then made sure to put them in the ballot box and, what I found out about mine was that the glue didn’t stick right … So I, I was really disappointed when I heard that this was the reason why my ballot wasn’t counted, just because of the, the number of sacrifices and arrangements we made to try to get this to take part in the, in the vote and I especially want my vote to count because I did it legally.”

“I want my vote to be counted, you know I had voted ever since I’ve been 18 years old, and I think it’s my right to do that and I want certain people in the offices, so I think something should be done,” Scott County voter Jo Donna Loetz said.

“I later found out that my ballot was not counted due to an issue with the envelope. So, yeah I was pretty disappointed because voting is very important to me as a woman and as an American citizen, I think it’s important to exercise your vote, your right to vote. And I was very sad to hear that my vote wasn’t counted because it’s important to me,”  Johnson County voter Sadie Rhomberg said. “I’m glad that we’re doing this and it’s pretty obvious that at least in Iowa, not all the votes were counted.”

War Has Been Declared On Corona Virus!

President Biden Declares War On The Pathogen

Stepping right up to the plate on day 1 of his administration, newly inaugurated President Joseph R. Biden said his administration will take bold and decisive action to end the ravage the virus has caused on the country. “100,000,000 vaccines in 100 days” Biden declared.

Biden then signed a series of executive orders to kick the war off, including an order to wear masks on federal property.

The Biden Administration is taking over for an administration that had no real plans for combatting the virus thus giving the virus pretty much an open field to grow in despite heroic efforts by medical personnel. States were left to their own devices to attempt to control the virus. This led to a hodge-podge of policies across the country including most Republican led states that had little in virus control policies.

With this declaration, the Biden Administration puts in place a coordinated national plan that will control the distribution and administration of vaccines. 

This will be a huge national effort in the vein of WWII or the space race of Cold War days. 

Our part as citizens in this battle will be very simple:

  1. Wear a mask in public. This is a simple request. You don’t want other people’s germs, they don’t want yours. Be an adult. Dressing fully these days means covering your mouth and nose. The same as you wouldn’t go out without pants, nor should you go out without a mask. No shirt, No shoes, No mask, no service.
  1. Stay home or stay out of crowds while the medical community has a chance to fight the enemy. If you must go out, wear a mask! Giving other people your disease is not your right or anybody else’s!
  1. When you turn comes, GET THE VACCINE! Do your part!

Be a patriot. Help your country and your fellow citizens out. The more everyone helps out, the sooner we get back to normal!

Sunday Funday: Never Thought I’d See It Edition

There was just so much history going on in the clip above it makes the mind spin. The first female member of the executive branch is sworn in as Vice-President of the United States. The VP is being sworn in on the personal bible of the late Supreme Court Justice Thurgood Marshall. 

Justice Marshall is in my humble opinion one of the greatest Americans ever to live. He crafted and executed the NAACP’s strategy to attack systemic racism through the courts. Marshall’s life was always in danger wherever he went because his strategy was highly successful. While others made headlines Marshall knocked down barrier after barrier. Most people will probably recognize Marshall’s signature win, the 1954 Brown v. Board of Education of Topeka, Kansas. This is the case that definitively struck down the bogus “separate but equal” fantasy for public schools and accommodations.

Then to add to the mix, the oath was administered by America’s only Latina justice and one of the handful of women that have served on the Supreme Court, Sonia Sotomayor. And as a little Easter egg in the whole proceedings I understand VP Harris wore purple in honor of Rep. Shirley Chisholm, the first woman to make a serious run at the presidency in the 1970s.

I mean a whole lot of history going on there, folks!

REMINDER! Iowa Senate District 41 Tuesday January 26th

A not so gentle reminder to you folks down in Iowa Senate District 41 in the southeast Iowa counties including all of Davis and Van Buren counties and most of Wapello and Jefferson counties. Tuesday is a special election to fill the seat left vacant by the resignation of Mariannette Miller-Meeks.

The Democratic candidate in this race is Mary Stewart.

More Dark Money To Corrupt Elections

If you are like my family, beginning Wednesday it was nice to be able to let a little bit of the guard down that we have had in place for at least four years. It was nice to hear the new President and Vice-President speak in full sentences with formulated thoughts behind the words. It was nice to think that they actually meant what they said – that there was no hidden meaning or that the words said were simply lies to hide what the real intentions were.

Unfortunately, this was the newly installed administration on display in contrast to the previous administration where deceit and “alternate realities” were their stock in trade. We would love to believe that the corruption and deceit went out with the old administration, but this is but one branch of our government. Left behind is a SCOTUS over which the public has little influence and whose members serve for life.

In our current situation, the Supreme Court through some very questionable maneuvering has become a 6 to 3 right wing majority where the ages of the right wing justices are 72, 70, 69, 56, 53 and 49. Those are people who will be around for a long time, some for 15 years and some more.

Since the Supreme Court decides what issues it will address, they can pick cases that can help keep their side in power for the long run. On the eve of the inauguration of a new administration, SCOTUS chose to take up two new cases that have the possibility of allowing much more untraceable campaign contributions to flow into our political system. Untraceable money in a democracy is a very bad thing. To survive, democracies must operate in the sunshine.

The cases in particular arise from California and are concerned with so called “non-profit charities.” The following is from the AP. As with many SCOTUS cases the details can be a bit hard to follow. In short, the question is whether donors can contribute large amounts without disclosure to so-called “charities” where that money will be used for political purposes:

The Supreme Court will decide whether California can collect the names and addresses of top donors to two conservative nonprofit groups, including one with links to billionaire Charles Koch.

The justices on Friday agreed to hear an appeal from the two groups, Americans for Prosperity Foundation and Thomas More Law Center, that argue the state’s policy violates the First Amendment and would deter people from giving.

A federal appeals court in San Francisco had ruled that the information serves the important state goal of preventing charities from committing fraud and was unlikely to be released publicly.

California requires all charities that collect money from state residents to give the state an Internal Revenue Service form identifying their largest contributors. The state is not allowed to disclose the names publicly, but state officials say they need the names to determine whether a group is really doing charitable work and is not involved in illegal business activity.

Americans for Prosperity Foundation is a charitable organization connected to the primary political organization supported by Koch and his brother, David, who died in 2019. Koch’s organizations have spent hundreds of millions of dollars supporting Republican candidates and conservative policies, making them frequent targets of attacks by Democrats.

Commenting on these cases radio host Thom Hartmann points out:  

Back in 1907, to stop the Robber Barons of the day from using their massive corporate resources to corrupt politics, Republican President Teddy Roosevelt pushed the Tillman Act through Congress, which made it a federal crime for any corporation to give any kind of money or other support to any candidate for federal office.

It stood for more than a half a century before conservatives on the Supreme Court with their “corporations are persons, my friend“ ideology struck it down.

Now that the Supreme Court has broadly let corporations involve themselves in politics, two very politically active corporations are demanding that they should be able to influence politics and politicians without anybody ever knowing are the actual humans behind their efforts.

These corporations demand the “right” to put forward and sponsor candidates and legislation that will serve their interests without American voters ever realizing that those candidates are actually front men for some of America’s most powerful oligarchs.

In this case before the Court, the rich don’t just want their corporations to essentially take over the American political process; they want to make it impossible for the people subject to the power of law and government to know who is really behind the scenes pulling the strings.

What can we do about this? There are no elections, no marches or any way to pressure the Supreme Court. This is why McConnell and the previous administration put so much of their effort into control of the courts in general and SCOTUS in particular.

Thom Hartmann’s conclusion?

There’s little we as citizens can do to influence the Supreme Court. But Congress can change the entire character of the Court by expanding the number of justices to reestablish a rational ideological balance.
