The Future of Iowa

Are you mad about Governor Reynold’s decision to waste money giving Apple a 20-million-dollar tax break? You should be.

She just gave Apple a 20-million dollar tax break to build a data center in Iowa, something one of the world’s richest corporations was going to do anyway.

Iowa does not need to bribe large corporations to build big data centers here.
Electricity is a data center’s biggest ongoing cost. Iowa has lots of low cost, reliable, renewable electricity.

Iowa is also relatively free from earthquakes, has lots of water and our winters reduce the cost of cooling hot computer servers.

In addition, there’s already an Iowa sales tax exemption on the electricity consumed by data centers, a tax break worth tens of millions of dollars.

With those built-in advantages, why did Apple—and Facebook, Microsoft, and Google before Apple—get tens of millions of additional Iowa tax dollars to do what they were going to do anyway?

The answer: the millions came from a broken state economic development program that is an open checkbook on autopilot.

The deceptively named “High Quality Jobs” program showers large corporations with state tax dollars based on construction and building costs. The giveaways have more to do with fattening the bottom line than they do with the number of new jobs created.

Since 2011, the “High Quality Jobs” program has cost Iowa taxpayers more than $352 million in tax exemptions. For that enormous sum, we’ve gotten just 1,300 new jobs in return-at a cost of nearly 3 million dollars per job!

And, unlike families seeking help with nursing home costs or college tuition bills, these large corporations do not have to prove they need the money.

In short, Apple, the richest corporation on the planet with a value of $750 billion, did not need a handout from Iowa taxpayers to build this data center.

Governor Reynolds’ budget crisis can’t be solved without dealing with the fastest growing part of state spending: tax giveaways.

And we can’t jump start our state’s economy until we stand up to powerful Des Moines special interests, and direct more resources towards small towns and rural areas.

This won’t be easy, because corporate-backed Republicans control Iowa’s state government from top to bottom.

Everyone trying to change that fact faces a daunting deadline.

The 2018 election will be here before we know it. There will be an election for Governor, and half the Iowa Senate seats and all the Iowa House seats will be up for election.

I believe this election will determine the future of Iowa.

Look what’s happened since radical Republicans took complete control of Iowa’s state government in the Trump Election.

In short order they:
• Gutted Iowa’s collective bargaining laws
• Closed women’s health clinics
• Slashed state help for victims of domestic abuse
• Cut the wages of more than 60,000 minimum wage workers, many in Johnson County
• Deeply cut Iowa’s grossly inadequate efforts to protect at risk children
• Cut tens of millions of dollars from our state universities (and plan to cut much more)
• Threw Iowans dying from asbestos poisoning under the bus
• Made it harder for you, me, and every other Iowan to vote
• Weakened environmental protections and cut funding for the Leopold Center
• And much more, taken straight from the Koch Brothers/Fox News/Breitbart playbook.

A big reason Iowa Republicans are destroying Iowa education and selling off our health care safety net is to fund corporate handouts like the Apple deal.

To stay in power, they are attacking working people and making it hard for Iowans to vote. Remember, there is nothing in Iowa’s constitution to prevent them from gerrymandering our election districts, like they’ve done in almost every other Republican-controlled state.

Are you mad about any of this? Are you working to flip Iowa from red to blue? You should be.

Iowa’s Joni Ernst One Of Top Recipients Of NRA Support

*Update 02-16-18:  Doubling down on her pledge of allegiance to the NRA, Joni Ernst repeated this absurd talking point after the mass shooting with a military style automatic weapon this week in a Florida high school.

“Mental health care, not gun regulation, is key to ending mass shootings.”

She’s sticking with the NRA, folks. This will never change as long as she is in office.

Data via the Center for Responsive Politics

iowainformer.com/politics/2017/10/nra-backed-iowa-congress-members-offer-thoughts-and-prayers-to-las-vegas-victims/

The five GOP members of Iowa’s congressional delegation have consistently opposed proposals to strengthen regulations against guns including ones for stronger background checks. They have all earned “A” ratings (or “AQ” ratings, an equivalent rating based on questionnaire responses instead of votes) from the National Rifle Association, which has spent nearly $3.8 million to help them remain in Congress since the 2010 election cycle.

On Monday, in the wake of a Sunday night massacre claiming at least 58 lives at a concert in Las Vegas — the worst mass shooting in US history — they offered thoughts and prayers to the victims and their families. Such condolences have become routine after deadly shootings but, thanks in large part to the aggressive lobbying by the NRA, rarely do the incidents result in meaningful policy changes gun control advocates want.

Ernst is one of Congress’ biggest recipients of NRA support in recent years — over $3.1 million. Most of that came when she first ran for the Senate in 2014, when the NRA dropped nearly $2.8 million in independent expenditures including TV ads targeting her Democratic rival, then-Congressman Bruce Braley.

Congressman David Young, a former Grassley aide, has received $384,921 from the NRA since 2014 in the form of direct contributions and independent expenditures.

Congressman Rod Blum, who’s received a more modest $16,215 in support from the NRA since 2014, tweeted a clip of President Trump’s response to the massacre instead of offering thoughts and prayers. The NRA was one of Trump’s biggest supporters; despite Trump’s claims that he ran a self-funded campaign, the NRA spent $30.3 million on his behalf.

Congressman Steve King has yet to issue a statement on the Las Vegas massacre. But he’s also a reliable ally of the NRA, which has given him $54,183 in direct and independent expenditure support since the 2012 election cycle.

SCOTUS To Hear Case Designed To Gut Unions

Grassley’s Obstruction About To Pay Huge Returns For The Wealthy

Thursday morning the Supreme Court agreed to hear Janus v. AFSCME

The SCOTUS has once more agreed to hear a case designed to gut public unions. In 2016 an 8 person – following the death of Antonin Scalia – SCOTUS deadlocked on a similar case 4 to 4.

Following Scalia’s death the radically right wing Republican Party went into the longest and worst ever obstruction in the history of this country. Led by Iowa’s own Chuck Grassley senate Republicans refused to even hold a confirmation  hearing for the Obama nominee for the high court, Merrick Garland.

In the beginning there were hopeful signs that this insane display of partisanship might actually result in the unthinkable – Chuck Grassley losing his senate seat. Grassley’s move was so unpopular that he took to holding his claim to fame “99 county tour” in the smallest towns at the strangest times. Even then he couldn’t avoid the questions on his constitutionally questionable obstruction.

It looked like maybe for once Iowans were finally catching on to Grassley’s highly partisan politics. Iowans finally realizing that for Grassley it is Party first and then little else mattered.

Then what happened is still being investigated. One can only say that it looked like Grassley had done himself in with his partisanship, but rose from the ashes to once again waltz back to the senate.

And thus his obstruction worked. One of the new senate’s first orders of business for Republicans was to confirm perhaps the most “conservative” (I prefer reactionary) justices ever to the Court. Gorsuch is pretty much a lock for Republicans on every issue as are Alito and Thomas. Roberts nearly so and Kennedy while not a sure thing is close to a sure thing.

So Thursday morning it was announced that the writ of certiorari had been granted to the case of Janus v AFSCME. This case concerns “agency” or “fair share” fees collected by unions from non-union employees whom the unions are required to represent.

Since a similar case last year ended in a 4 to 4 deadlock, it is probably a safe assumption that with Gorsuch’s vote it will be 5 to 4 against the union. It is also a safe assumption that this will be only the first of many cases that will be used to tear at the fabric of unions in this country.

Here is a summary from thinkprogress.org:

Unions are required by law to bargain on behalf of every worker in a unionized shop, even if those workers opt not to join the union. As such, non-members receive the same higher wages (one study found that workers in unionized shops enjoy a wage premium of nearly 12 percent) and benefits enjoyed by their coworkers who belong to the union.

Absent something else, this arrangement would create a free-rider problem, because individual workers have little incentive to join the union if they know they will get all the benefits of unionizing regardless of whether they reimburse the union for its costs. Eventually, unions risk becoming starved for funds and collapsing, causing the workers once represented by a union to lose the benefits of collective bargaining.

To prevent this free-rider problem, union contracts often include a provision requiring non-members to pay agency fees.

The plaintiff in Janus asks the Supreme Court to declare these agency fees unconstitutional, at least in contracts involving public sector unions, under what can charitably be described as an aggressive reading of the First Amendment. Indeed, prior to his death, even conservative Justice Antonin Scalia sometimes appeared skeptical of the plaintiff’s legal theory (although he did join an opinionthat embraced much of it).

With Gorsuch on the bench, however, there is little suspense regarding how Januswill come down. Unions will almost certainly be severely weakened by this decision. And, as a benefit to the Supreme Court’s increasingly partisan majority, that will also weaken a key arm of the Democratic party’s political infrastructure, making it more likely that the Court will remain in Republican hands.

One other side effect of the destruction of unions in this country is that unions are one of the best defenses against the excesses of government and one of the few organizations that can stand up to fight the collusion between corporations and government. We have seen in the years since Reagan what weak unions have meant to corporations.

Also don’t forget that without unions all working people have fighting for them is the likes of Grassley. That should scare the hell out of anyone.

Sunday Funday: Jane Goodall Appreciation Edition

Image (1) chimp.gif for post 1512There are many reasons to appreciate Jane Goodall. Her work studying primates for over 50 years has led to insights into human behavior. In that vein, Goodall made some comparisons between the current president and chimpanzee behavior for the Atlantic last year. This was rehashed and added to in a recent edition of the British newspaper the Independent by Prof. Dan P. McAdams.

Perhaps my favorite comparison is the tweeting habit of the current president:

Describing what he called a male chimpanzee’s “charging display” in an article in The Guardian, Professor Adams, of NorthwesternUniversity, said: “The top male essentially goes berserk and starts screaming, hooting, and gesticulating wildly as he charges toward other males nearby.”

He added: “Trump’s incendiary tweets are the human equivalent of a charging display: Designed to intimidate his foes and rally his submissive base, these verbal outbursts reinforce the President’s dominance by reminding everybody of his wrath and his force.”

It is a good, short, amusing read for a Sunday morning.

I can’t keep up any more.

1) HHS Secretary Tom Price said he will pay back $51,000 for rides on private jets he took . What is the estimated cost to US taxpayers for these flights?

2) While he was a congress member Price was involved in what practice that is illegal for congress members?

3) The ACA once again survived an attack by extreme right Republicans. Who was the final Republican senator to voice opposition that sunk this attack?

4) Happy birthday Mr. President! Having survived brain cancer a couple years back, what former president turns 92 today?

5) The current administration was slow in revoking what arcane shipping law, thus severely delaying aid getting to Puerto Rico?

6) Facing a huge natural crisis in Puerto Rico, the current president chose instead to focus his attention on a tiny kerfuffle with players in what sports league?

7) As it looked more and more like the ACA would not be repealed, the bill was changed to keep the ACA in effect in what state to try to buy that state’s senator’s vote?

8) Invoking some old memories, an anti-immigrant party in what European country scored significant gains in the national election last Sunday?

9) Despite not having a vote on killing the ACA, Iowa’s senators both came down on what side of repealing the ACA?

10) What major chain retail announced it will raise its minimum hourly wage to $11 starting in October?

11) “Lock them up, Lock them up!” What power couple in DC was revealed to be conducting government business on private email?

12) In a move that may hurt Iowa’s chances of getting an NFL team, what top Iowa official criticized players for kneeling for the national anthem?

13) Friday night to Saturday night (Sept. 29 & 30) was the celebration of what major religious feast?

14) The first Monday of October is traditionally the opening for what branch of the federal government?

15) Protesting wasn’t limited to football fields. Students and faculty at what university linked arms and took a knee for an appearance by AG Sessions?

16) Because they were “not fit and proper” London, England refused to renew the license of what taxi company?

17) In what seems to pop up every few years, coaches in what college sport have been arrested in a bribery scandal?

18) Following the major data breach suffered by his company, Equifax CEO Richard Smith got a golden parachute worth how much?

19) Another one bites the dust! What Republican senator announced he will not run for re-election in 2018?

20) In a proxy battle between Bannon and Trump for preeminence in the Republican party staged in the Alabama primary, who did Republicans pick as their senate candidate?

Sorry I missed last week, we had some family business to attend to.

Answers:

1) well over $1million

2) stock trading based on inside information obtained because of his position

3) Susan Collins of Maine

4) Jimmy Carter

5) the Jones Act

6) the NFL

7) Alaska

8) Germany – the Alternative for Germany (AfD) party got 13% of the vote

9) Ernst and Grassley both came out for repeal

10) Target

11) Ivanka Trump and Jared Kushner. Seems like Kushner just doesn’t follow any rules

12) Governor Reynolds. There goes the Des Moines franchise.

13) Yom Kippur

14) the Supreme Court

15) Georgetown

16) Uber

17) basketball.

18) $90 million.

19) Bob Corker of Tennessee

20) Roy Moore – a candidate that is way out there.

Don’t forget that the protests in the NFL concerned the rising death count of black citizens at the hands of police. It is not about disrespecting the flag as politicians such as Kim Reynolds and Joni Ernst pretend.

From Bruce Bartlett: Tax Cuts Don’t Work

One Of The Designers Of The Gospel Of Tax Cuts Says: It Is Hogwash

(25 minutes total for both videos)

At the national level, we are about to head into a major debate on the budget. Trump and the radical right Republican congress will be pushing for a tax “reform” that will reward the rich, punish the poor and screw the middle class in ways they won’t even understand. The bottom line is that their rich donors and owners (the Kochs and others) want those huge tax cuts badly enough to threaten to buy new politicians if this group won’t come through for them.

At the state level, Iowa is going through a budget crisis like it has never experienced before. This is a crisis purely made by budget mismanagement by Iowa’s version of radical right wing Republicans who have slashed taxes for corporations and handed them bundles of our tax dollars in some dream that this will fix the economy. Instead Iowa’s economy continues to spiral out of control downward. Instead of facing reality, the radical republicans continue to follow the Kansas example into oblivion.

Wednesday Bruce Bartlett, one of the creators of the myth of trickle-down and tax cut myths, was a witness at a House Democrats tax forum. The following are excerpts from a USA Today article on his prepared testimony:

“I know something about this subject. Forty years ago, while working for New York Rep. Jack Kemp, I helped originate the Republican obsession with slashing taxes that came to be called “supply-side economics.” While I believe this theory played a useful role in economic theory and policy in the late 1970s and early 1980s, it has long outlived its usefulness and is now nothing but dogma completely divorced from reality.

{snip}

Thus Republicans have long argued out of both sides of their mouths. On the one hand, they assert, without any evidence, that tax cuts pay for themselves by greatly expanding the economy, and that tax cuts will starve the beast and reduce spending. Thus in Kansas, the state hired Arthur Laffer, one of the original supply-siders, to say that tax cuts would pay for themselves. When taxes were slashed and revenues collapsed, the Republican governor and legislature sharply cut spending. It is Republican dogma that all deficits result from excessive spending, never from tax cuts.

{snip}

Republicans believe that statutory rates of taxation are all-powerful, even though almost no one pays them; deductions, credits and exclusions reduce the effective tax rate (taxes divided by income) in many cases to zero. But the historical experience tells us this theory is nonsense. The Tax Reform Act of 1986 reduced the top personal income tax rate to just 28% from 50%, and the corporate tax rate to 34% from 46%. Yet there was no increase in the rate of economic growth in subsequent years and by 1990 the economy was in a deep recession.

Strenuous efforts by economists to find a growth effect from the 1986 act have failed to find any. There were accounting effects as income was shuffled around to take advantage of tax changes, but no rise in investment or any significant effect on labor supply. “The aggregate values of labor supply and saving apparently responded very little,” economists Alan Auerbach and Joel Slemrod concluded in an authoritative study.

Virtually everything Republicans say about taxes today is a lie. Tax cuts and tax rate reductions will not pay for themselves; they never have. Republicans don’t even believe they will, they are just excuses to slash spending for the poor when revenues collapse and deficits rise. There is no evidence that tax reform raises growth, although it may improve fairness and tax administration. And the Republican idea that tax increases always crash the economy is belied by the experiences after Bill Clinton raised taxes in 1993 and Barack Obama did the same in 2013. The economy grew nicely and the stock market boomed in both cases.”

Here we have a Republican who is facing reality. In the next few months we will once again hear what are now long disproven myths and long since proven lies trotted out as “facts” (alternatives facts, anyone?). Sadly we will see little push back from the corporate media.

The easiest refutation of the radical right’s economic views the presidency of Bill Clinton. Taxes were raised, debts were paid down and economic order was restored to some degree. The Bush II presidency stood in direct contrast to the Clinton presidency and we saw what that led to.

Now we are at the beginning of another round of mythic economics. We know how this will turn out before it starts. We have been there before. Hopefully Democrats can stop it in its tracks.

But what if Bernie Sanders in particular had been elected? Here is one view from the Thom Hartmann Show. (Note: we would have had some of these results had Clinton been elected) 10 minutes

If you are unfamiliar with the “Two Santa Claus Theory” commondreams.org has a good write up here.

By 1974, Jude Wanniski had had enough. The Democrats got to play Santa Claus when they passed out Social Security and Unemployment checks – both programs of the New Deal – as well as when their “big government” projects like roads, bridges, and highways were built giving a healthy union paycheck to construction workers. They kept raising taxes on businesses and rich people to pay for things, which didn’t seem to have much effect at all on working people (wages were steadily going up, in fact), and that made them seem like a party of Robin Hoods, taking from the rich to fund programs for the poor and the working class. Americans loved it. And every time Republicans railed against these programs, they lost elections.

Everybody understood at the time that economies are driven by demand. People with good jobs have money in their pockets, and want to use it to buy things. The job of the business community is to either determine or drive that demand to their particular goods, and when they’re successful at meeting the demand then factories get built, more people become employed to make more products, and those newly-employed people have a paycheck that further increases demand.

Wanniski decided to turn the classical world of economics – which had operated on this simple demand-driven equation for seven thousand years – on its head. In 1974 he invented a new phrase – “supply side economics” – and suggested that the reason economies grew wasn’t because people had money and wanted to buy things with it but, instead, because things were available for sale, thus tantalizing people to part with their money. The more things there were, the faster the economy would grow.

Destroying Net Neutrality

From: Lucia, FreePress.net

Contact you senators to reject Ajit Pai

Image (1) freepress.png for post 35515

FCC Chairman Ajit Pai is against Net Neutrality and affordable internet access. What’s he for? Letting a racist media empire get even more reach and power.

Now some good news: The Senate has to reconfirm Pai or he’s out. If you haven’t already, call (413) 923-6120 and you’ll be automatically connected to your senator’s office.

When you make the call, you’ll hear a brief message from us before you’re connected to your elected officials. Here’s what you can say to them:

I’m calling to urge you to vote against the renomination of FCC Chairman Ajit Pai because of his attacks on Net Neutrality and the Lifeline program and his support for the Sinclair merger.

Time is running out: Call (413) 923-6120 today and urge your senators to fire Pai.

Thanks—

Lucia

It’s time for a break-up.

Any day now, the Senate will vote on whether to reconfirm FCC Chairman Ajit Pai — and we’re urging senators to dump him.

Since Pai joined the Commission, he’s worked to undo policies designed to protect internet users, communities of color and poor people. While he’s supposed to protect the public interest, he’s continuously voted against it and sided with the deep-pocketed corporations — like Verizon — that once employed him.

A vote for Pai is a vote for a corporate-controlled internet. Pick up the phone now and urge your senators to vote against Pai’s renomination. Call (413) 923-6120 and you’ll be automatically connected to your senator’s office.

When you make the call, you’ll hear a brief message from us and then be connected to your elected officials. Here’s what you can say to them:

I’m calling to urge you to vote against the renomination of FCC Chairman Ajit Pai because of his attacks on Net Neutrality and the Lifeline program and his support for the Sinclair merger.

Pai has made it clear that he doesn’t care about protecting the communication rights of everyday people. Time and time again he’s failed to stand up for those he’s sworn to serve. This is unacceptable. And now the Senate has the opportunity to intervene on the public’s behalf.

We don’t have a lot of time. Call (413) 923-6120 and tell your senators that a vote for Pai is a vote to:

• End the internet as we know it by destroying Net Neutrality protections.
• Let Trump’s favorite media empire Sinclair — known for its racist coverage and anti-Muslim “must-run” broadcasts1 — gain even more reach and power.
• Shut off phone and internet service for people who are struggling by attacking the Lifeline program.

Not a single senator should support that agenda.

Tell the Senate to stand up for what’s right and fire FCC Chairman Ajit Pai. (He does a better job of representing Verizon’s interests anyway.)

Call (413) 923-6120 to be automatically connected to your elected officials.

Thanks for all that you do—

Lucia, Candace, Dutch and the rest of the Free Press Action Fund team
freepress.net

P.S. Call (413) 923-6120 now, and tell your senators that it’s time to break up with FCC Chairman Pai. A vote for Pai = a vote to end the internet as we know it.

We Need Dave in Congress

We got mail from former IDP Chair Sue Dvorsky:

You and I both know why you’re getting another email asking for money. It’s no secret that September 30th is the next FEC fundraising deadline. And you’re probably getting a boatload of emails. Believe me, I get them too.

But how many are you getting on behalf of a member of Congress from Iowa with a (D) next to their name?

That’s what I thought. You’ve gotten a couple, you may have even opened one, and even thought about clicking that donate button.

We need Dave in Congress, period.

But we can’t do it without you. So what are you waiting for? Chip in before midnight, and let’s put some fear into the GOP’ers who think they’ve got a shot at Dave’s seat. (Just click the button, it’s easy)

As long as I’ve known Dave Loebsack, I’ve known him to put the people he represents first and foremost.

And honestly, it’s something we need more of at every level of government. I’ve seen more than my fair share of campaigns and candidates. And believe me, Dave’s not just one of the good ones, he’s one of the best.

He puts his head down and gets to work to help the people he’s elected to serve, no matter who’s in the Oval Office, or who’s in the majority.

If you want to keep someone in Congress who’ll work to help the people they represent, then join me and step up for Dave Loebsack. He needs all of us!

Thank you!

Bring Back the Fairness Doctrine and Return Our Country to Sanity

Bring Back The Fairness Doctrine.

The Fairness Doctrine is constitutional, sets guidelines for honest and equitable newscasting and editorial, and is necessary due to media consolidation.

“The Fairness Doctrine has been constitutionally upheld by the Supreme Court. It was the law of land from 1949 until 1987 (38 years). The cited reason for deregulation of the Fairness Doctrine was the advent of cable television creating multiple news options. Now all those cable channels are owned by an oligopoly of about 6 corporations. The Fairness Doctrine helps guarantee the news is factual and assures differing sides of an issue are given equal representation. The Fairness Doctrine augments Fee Speech and it’s purpose is to create a better informed citizenry. Bring Back the Fairness Doctrine!!! ”

But of course the demise of the Fairness Doctrine is what allows for the existence of  right wing media, that is, Fox News and right wing radio, propaganda disguised as “news” and giving the GOP, liars in chief, cover.  So you can see why Grassley just wasn’t having the return of the Fairness Doctrine or anything like it under the Obama administration. Here is Grassley’s letter to Obama’s FCC Chairman Julius Genachowski where he is totally freaking out about the possibility of diversity and localism  in media and the possible return of the Fairness Doctrine.

https://www.grassley.senate.gov/news/news-releases/grassley-asks-fcc-chairman-clarify-fairness-doctrine-statements

“The appointment of Mark Lloyd to be the Associate General Counsel and Chief Diversity Officer is at odds with assurances that the FCC would not reinstate the Fairness Doctrine that Mr. Genachowski made prior to his U.S. Senate confirmation,” Grassley said.  “I hope Mr. Genachowski stands by his word and reaffirms his commitment to me that the FCC won’t be considering anything that accomplishes the goals of the Fairness Doctrine.”

The text of Grassley’s letter is shown below or by clicking here.

August 14, 2009

Julius Genachowski
Chairman
Federal Communications Commission
445 12th Street, SW
Washington, DC 20554

Dear Chairman Genachowski,

On July 29, 2009, you announced the appointment of Mark Lloyd as Associate General Counsel and Chief Diversity Officer for the Federal Communications Commission (FCC).  I write today to express my concerns with this appointment and ask for you to clarify and reaffirm statements you made to me in a personal meeting prior to your confirmation related to the Fairness Doctrine and efforts to diversify broadcast media.

On April 22, 2009, before your confirmation by the U.S. Senate for your position as Chairman of the FCC, you came to my office and told me that you did not support an effort to reinstitute the Fairness Doctrine.  I took you at your word that, if confirmed, the policies that you promoted at the FCC would not include any policy or regulatory shifts that seek to reintroduce the long abandoned Fairness Doctrine.  However, I have serious reservations that you may be moving away from these statements you made to me regarding the Fairness Doctrine given the appointment of Mr. Lloyd to a position within the Office of the General Counsel (OGC) at the FCC.  Please allow me to elaborate.

My concerns relate to Mr. Lloyd’s participation in scholarly writings on political talk radio, the Fairness Doctrine, and efforts to bring greater diversity to talk radio.  Prior to joining the FCC, Mr. Lloyd served as a Senior Fellow at the Center for American Progress (CAP), in addition to positions as a professor at the Georgetown Public Policy Institute.  In his capacity as a Senior Fellow at the Center for American Progress, he coauthored a paper titled, “The Structural Imbalance of Political Talk Radio.”  This paper argued that radio programming was currently “imbalanced” and that there are “serious questions about whether the companies licensed to broadcast over the public airwaves are serving the listening needs of all Americans.”  Mr. Lloyd’s paper suggests three options to remedy the “imbalance” in political talk radio, including (1) restoring caps on commercial radio station ownership, (2) ensure greater accountability in licensing, and (3) require owners who fail to enforce public interest ownership obligations to pay a fee.  While these remedies seem innocuous on their face, hidden within the paper are some stark revelations.

First, Mr. Lloyd’s paper suggests that the Fairness Doctrine was “never formally repealed.”  Instead, Mr. Lloyd argues that the FCC merely announced “it would no longer enforce certain regulations under the umbrella of the Fairness Doctrine.”  The paper continues by stating that while the D.C. Circuit Court of Appeals upheld the FCC decision, the Supreme Court has “never overruled the cases that authorized the FCC’s enforcement of the Fairness Doctrine…thus it technically would not be considered repealed.”

Second, the paper suggests that the FCC revise the licensing process for radio broadcasters.  Specifically, it suggests that licenses should not be permitted for longer than three years, that they be subject to challenges in the decision to renew their licenses, and that they submit to strict documentation and regulatory requirements.

Finally, and perhaps most importantly, the paper suggests that commercial radio owners be subjected to new regulatory requirements enforcing public interest obligations and if they fail to meet these standards, subjecting them to fees and taxes in order to compel compliance.  The paper suggests that such a fee or fine structure could raise between $100 million to $250 million in new revenue, but would not “overly burden commercial radio broadcasters.”

Taken together, these statements represent a view that the FCC needs to expand its regulatory arm further into the commercial radio market.  However, it would be unfair for me to say that Mr. Lloyd has specifically advocated for a return to the Fairness Doctrine.  Instead, he has argued that the Fairness Doctrine is unnecessary if other regulatory reforms to commercial radio are implemented.  Specifically, in discussing the CAP paper “The Structural Imbalance of Political Talk Radio,” Mr. Lloyd authored an internet article published on CAP’s website entitled, “Forget the Fairness Doctrine.”  In that piece, Mr. Lloyd stated, “we call for ownership rules that we think will create greater local diversity…we call for more localism by putting teeth into the licensing rules.  But we do not call for a return to the Fairness Doctrine.”

Simply put, I strongly disagree with Mr. Lloyd.  I do not believe that more regulation, more taxes or fines, or increased government intervention in the commercial radio market will serve the public interest or further the goals of diversifying the marketplace.  I am concerned that despite his statements that the Fairness Doctrine is unnecessary, Mr. Lloyd supports a backdoor method of furthering the goals of the Fairness Doctrine by other means.  Accordingly, I ask that you clarify and reaffirm your commitment to me to oppose any reincarnation of the Fairness Doctrine.  Further, I ask you to affirmatively state that you will not pursue an agenda that includes any new restrictions, fines, fees, or licensing requirements on commercial radio that would effectively create a backdoor Fairness Doctrine.  I appreciate your prompt reply regarding this important matter.

Sincerely,

Chuck Grassley
United States Senator
