Iowa High Court: Neighbors May Sue Hog Farmer

Almost
overlooked last week in the hoopla surrounding the Iowa Values Fund was
this bit of good news from the Iowa Supreme Court.




A
state law that shields a Sioux County hog operation from nuisance
lawsuits violates the rights of a neighboring farm couple who
complained of odors, the Iowa Supreme Court ruled Wednesday.




Legal
authorities said the ruling has broad implications and gives new hope
to Iowa property owners and conservationists who have fought large
livestock feeding operations for more than a decade.




The
ruling means “if you live in your house, and the nuisance moves to you,
you have a case,” said Thomas Lipps of Algona, who represented the farm
couple. “If the nuisance is there and you move to the nuisance, the
confinement operation gets the protection of the law.




“The person who is there first rules.”

    Halleluha! Finally, something substantial the good people of IOWA have to back them up. There are those who became disoriented, had blackouts, experienced memory loss, became brain damaged, or have died because of the severe ammonia stench from hog lots. Soon we all need to make the determination whether our health is more important or that certain industries will prevail. This is a social issue that needs to be addresses by more & more of us. Dr. Kay Kimball in his book “Chemical Brain Damage” (that's right his name is Kay) addresses this after decades of research. He also discusses other damaging substances we are exposed to daily. The book is difficult to find, I had to have my library contact a Des Moines library for it. Please pay attention to this important issue so IOWA's rural areas don't become home to big, ugly, toxic, death traps.
